The protection and the confidentiality of your data are especially important to us, heysite GmbH (“heysite”). The collection and use of your personal data shall therefore take place exclusively within the framework of the statutory provisions of applicable data protection law. With this data protection declaration, we shall inform you about the type, the scope, and the purposes of the collection and use of personal data within the context of your using our website located at heysite.io.

Subject matter of data protection

Personal data are the subject matter of data protection. As contemplated under § 3 para. 1 of the Bundesdatenschutzgesetz (the Federal Data Protection Act, the “BDSG”), these data are specific individual details concerning personal or factual relationships of a certain or of an identifiable natural person. Included among these are, e.g., details such as name, mailing address, email or telephone number, but also use-related data as applicable. Use-related data are data which are necessary in order to use our websites, e.g., log-in data as well as details concerning the commencement, the end, and the scope of the use of our website.

Collection and use of your data

Automated data collection

When the heysite websites are accessed, for technical reasons your internet browser automatically transmits data. The following data are separately saved from other data which you transfer to us under various circumstances.

  • Date and time of accessing,
  • browser type/version,
  • operating system used,
  • URL of the previously visited website,
  • quantity of data sent, and
  • your abbreviated IP address (only at registration or log-in).

These data will be saved exclusively for technical reasons and at no time will they be assigned to a particular person.

Data entered by the user

In order that you can use all the advantages of our website, you will have to register on our website or authenticate yourself through one of the social media log-ins offered by us, e.g., Facebook or Twitter (“Social Networks”) (see Sect. 3.3). When registering on our website, you will have to enter your email, your user name, and a password. These data are required in order to set up and manage a user account for you, and so that you can use the entire offer from heysite.

In addition, you will have the opportunity to send us requests, questions, criticisms, or other information with the aid of our contact form. In so doing, we collect and process the data entered by you, in order to process your inquiry.

Social Media Login

In the use of a social media log-in, an authentication is effected as follows: you click on our website on the button to log in through a Social Network supported by us. Then you are forwarded to the website of the Social Network. There, you enter your identification and your password and consent to the transfer of certain information from your personal profile at the Social Network to heysite. Such information encompasses the following data:

  • the name provided to the Social Network,
  • your email,
  • your profile photo, as applicable (if provided to the Social Network);
  • your age, as applicable (if provided to the Social Network);
  • your gender, as applicable (if provided to the Social Network).

In keeping with the principle of data economy, we retrieve as little information as necessary in order to enable your authentication or your use of our website. We use the retrieved information exclusively for the registration process on our website and for creating your profile. After logging on, you will be brought back to our website by the website of the Social Network with a session identification number, and you will be able to use the relevant functions of our website. Data about you, e.g., the browser used, operating system used, as well as your IP address and data regarding your use of the website, e.g., date and time of the visit to our website, shall be transferred to the Social Network with which you have logged on. This information can be used by the Social Networks, e.g., for purpose of advertising. Whether and to what extent your data are actually being used by the respective Social Network is not within heysite’s sphere of influence, and the use of these data shall be exclusively a matter of the data protection provisions of the respective social network.

Voluntary data

In addition, heysite offers you the opportunity to personalize your profile. For example, you can provide specific information about your interests, links to your social profiles, and so forth. Furthermore, you can upload a photograph of yourself onto your profile site. Please be aware that all data and photos voluntarily made available on your profile will be accessible to other users. Therefore, you should carefully select what you post in your profile and release to other users through it.

Interactive area

On the website, heysite offers you the opportunity to create, work on, or save data in a centralized location and to optimize it for sharing with third parties in Social Networks or through other distribution paths (the “Interactive Area”). When using our services, you have to be aware that the shared content can be made publicly accessible in accordance with your settings, and that all information that you share can be viewed by third parties. We cannot monitor how those with whom you share content will use it. The content posted can be saved for an unlimited period of time. To the extent that you desire to have posted content removed, please erase it through the corresponding function offered by us, or send us an email at the address provided above.

Advertising purposes

In the event that you so desire, heysite will use your personal data to make available to you offers and information tailored to your needs and to inform you about new developments such as offers of improved services and other events. At any time, you can object to the use of your data for such opinion and marking purposes, effective prospectively. For this purpose, any communication, not requiring any special form and sent to the above-specified address, shall suffice.

Data sharing

Fundamentally, your personal data can be shared without your express prior consent only in the following cases:

  • If sharing serves to resolve an illegal use or is required for legal prosecution, then personal data shall be shared with the authorities responsible for prosecuting crime as well as with any injured third parties. Such shall occur, however, only if specific indications of illegal or abusive conduct are present. Sharing can also take place if such services the implementation of terms and conditions of use or other agreements. In addition, heysite is legally obligated to issue access to information upon inquiry from certain public offices. These are: (i) criminal prosecution authorities, (ii) authorities that pursue administrative offenses punishable by fines, and (iii) the finance authorities.
  • From time to time, we are dependent upon contractually bound third-party contractors and external service providers to render services, e.g., to save your content and to make it available. In such cases, information shall be shared with these companies or individual persons, in order to enable them to perform further work. These external service providers are carefully selected and regularly reviewed by us, in order to make sure that your privacy is maintained. The service providers shall be permitted to use the data exclusively for the purposes prescribed by heysite. Moreover, the service providers shall be contractually obligated by heysite to treat your data exclusively in accordance with this data protection declaration as well as with German data protection laws.
  • As part of the continued development of our business, it is possible that the structure of heysite GmbH is transformed, in that the legal form is changed, or that subsidiaries, parts of the company, or components are founded, purchased, or sold. In the event of such transactions, customer information shall be shared with the part of the company to be transferred. For every sharing of personal data with third parties in the above-described scope, heysite shall ensure that such takes place in conformity with this data protection declaration and the relevant provisions of data protection law.
Payment

We use Stripe, an offer of the American Stripe Inc. (hereinafter referred to as "Stripe") for the processing of payments (legal basis according to DSGVO, if and to the extent applicable): Article 6 paragraph). Stripe is certified according to both the EU American and the German American Privacy Shield and thus guarantees adequate data protection. In particular, Stripe has published the following information on the type, scope and purpose of data processing: data protection declaration, entry in the Privacy Shield list.

Newsletter

heysite offers you a newsletter service at no charge. With this newsletter, heysite will inform you about, among other things, information concerning our website, such as announcements or new features and participation in surveys, in order to make you aware of new products or offers or to let you receive information that may be of interest to you. Furthermore, in the newsletter we will occasionally inform you about offers and products from our cooperation partners. To receive the newsletter via email, you can check the box next to “Newsletter” under “Edit Profile” on our website.

You can unsubscribe from the newsletter at any time. Each newsletter contains the information describing how you can unsubscribe to the newsletter effective for the future.

Cookies

heysite deploys cookies for simple and practical use of the website. Whenever you visit one of the heysite websites, the heysite servers send a cookie to your computer. Cookies are small text files which are saved on your computer mostly for the duration of the current session, that is, until your browser is closed—but in some instances extending beyond that. In and of themselves, cookies do not identify you personally. All they identify is your web browser. To the extent that you do not identify yourself to heysite—e.g., by registering or by filling out an online form—you will remain unidentifiable to heysite.

Identification using session cookies

If you log onto our website, then heysite automatically uses a cookie to recognize your browser again (a so-called session cookie). This way, during the session you only have to enter your password one time when logging in, and you will not be repeatedly requested to do so while using the website. Most browsers accept cookies, but it is possible to set the browser to refuse cookies. In this event, the website will not function error-free. However, you can delete cookies anytime. If you do, however, then at your next visit you will have to log in again.

Persistent cookies

Persistent cookies remain saved even after your browser is closed or your computer is shut down. Persistent cookies are used by heysite to identify browsers which have already visited our websites and—to the extent desired by you—to log in automatically beyond the browser session. In this event, a unique ID is assigned to you. This unique ID is saved in a persistent cookie. heysite takes particular care to ensure the security and confidentiality of the information saved in persistent cookies. For example, no passwords are saved in persistent cookies. If you deactivate the reception of cookies through your web browser, then it may be possible that you cannot use the website to the fullest extent.

Website improvement

Google Analytics

heysite uses Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses so-called “cookies,” which are text files placed on your computer and which enable an analysis of your use of the website. The information generated by the cookie about your use of the website (including your abbreviated IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity for website operators and providing other services relating to website activity and internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google’s behalf.

Social Plug-ins

On its website, heysite uses plug-ins, including the social networks facebook.com, of Facebook Inc., 1601 S. California Ave., Palo Alto, CA 94304, USA, Twitter.com, of Twitter Inc., 795 Folsom St., Ste. 600, San Francisco, CA 94107, USA, as well as google +, of Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. You recognize plug-ins from their respective network logo, e.g., completed by the pictogram of a fist with the thumb pointing upwards or the additions “recommend,” “like,” or “comment.” Merely retrieving our website does not establish any direct connection or share any data with the servers of the social networks by the internet browser used by you. When you place the cursor on the “like” button, an information box will appear advising you that the “like” button will be activated only by your clicking on it, so it will become active only through clicking on it. Then, with a second click, you can provide your recommendation. If you have activated the “like” button, it transfers various data to the social network. Such data can include:

  • date and time of the visit to the website
  • URL of the website that the visitor is on
  • URL of the website that the visitor previously visited
  • browser used
  • operating system used
  • IP address of the visitor

To the extent that you are simultaneously logged onto Facebook, Twitter, or Google + during your visit to our website, it cannot be ruled out that the provider assigns the visit to your network account. If you use the plug-in functions (e.g., clicking on the “like” button or posting comments), then this information is also transferred from your browser directly to the respective social network and saved there, as the case may be. Erasure of your data

To the extent that your data are no longer required for the aforementioned purposes, they will be erased. If you erase your user account, then your profile will be completely and permanently erased. To the extent that data will have to be retained for reasons required by law, these will be blocked. The data will then no longer be available for any further use.

Right of access and rectification

Naturally, you have the right to request access to the data we have saved concerning your person. You also have the right to rectification of inaccurate data, to blocking, and to erasure. To do so, please contact us at privacy@heysite.io or by letter at the address listed above.

Amendments to this data protection declaration

For the use of the website, heysite will continually adjust this data protection declaration to the respective data processing. The current version of the data protection declaration can always be retrieved at heysite.io/home/privacy_policy.
